Fatwa: One who abandons prayer--kafir?

Question: What is the meaning of the hadiths that state that the one who abandons the prayer is a kafir? And what is the meaning of their statement that it is not obligatory for the kafir to make up?

Fatwa:

The meaning of the statement that the one who abandons the prayer is a kafir is that it is a major act of disobedience to Allah. Their statement that it is not obligatory for the kafir to make up refers to the apostate. Don't you see that the one who leaves an obligation is referred to as "kafir" when the Exalted says: {Pilgrimage thereto is a duty men owe to Allah,- those who can afford the journey; but whoever is kafir, Allah is not in need of any creation}. (Q. 3:97). He calls the one who avoids the Hajj a kafir.

الجواب: معنى قوله : إن ترك الصلاة كفر: أنها معصية لله من الكبائر ، و معنى قولهم: إنه لا يجب على الكافر قضاء: المراد به الملحد ، ألا ترى أنه قد أطلق على ترك بعض الواجبات كفر قال تعالى : (وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلًا وَمَنْ كَفَرَ فَإِنَّ اللَّهَ غَنِيٌّ عَنِ الْعَالَمِينَ ) فسمى ترك الحج كفراً.
