As-salamu alaikum wa rahmatu Llah. Who are the main authorities of fiqh zaidi who lived before Imam Al Qasim and in which zaidi books can I find their fatawa ?
wa alaykum as salaam wa rahmatullahi!

Thank you for your question! As for the main authorities of Zaidi fiqh, there were many imams before al-Qasim (as) who gave fatawa; however, there was no attempt to codify Zaidi fiqh before Imam al-Hadi's Al-Ahkaam. Indeed, Imam Ahmed bin Suleiman(as) said in his intro to the 'Usuul al-Ahkaam:

Verily, when I came upon many of the primary places of the Ahl al-Bayt as well as those of the other tribes, I found that the jurists of the Generality authored books on Islamic Law, reports, narrated traditions and other issues. We also found that they authored books on the narrated traditions from the Prophet, peace and blessings be upon him and his progeny, by day and by night. They compiled those traditions which they use as proofs; however, I did not find the same case with our pure imams or their devoted scholars. They were prevented from that due to their constant engagement in jihad as well as their being dispersed throughout the lands. It is also due to their fear of the people of stubborn opposition as well as oppression of those disbelievers and disobedient who oppressed them. They narrated many traditions in their books, as well as their sciences, reports and poems; however, the best book of Islamic Law they authored was the book Al-Ahkaam of al-Haadi ila al-Haqq, upon him be peace.

And Allah knows best!

Thank yo for your answer ! Peace be upon Imam Al Hadi ila al-Haqq !

So I wonder :

1 - Is there many differencies between the fatawa of Imam Zaid and Imam Al Hadi ?
2 - Who are the main authorities of the madhab after Imam Al Hadi ?
3 - Is there some zaidi fiqh books who narrated the fatawa of early Imam of Ahl Al Bayt like Imam Al Baqir, Imam As Sadiq, Imam Nafs Zakiyya, Imam Al Kamil or Imam Al Kazim ? Do you have some books titles ?
Thank you for your questions!

1. Although many Zaidis acknowledge that there are some differences between the fatawa of Imams Zayd and al-Hadi, upon them be peace, there are some considerations to keep in mind:

a) the imams of Ahl al-Bayt cannot differ in matters of halal and haram. This is because the Ahl al-Bayt are a hujjat upon the people and if they are shown to disagree about matters of the haram and halal, this would mean that Allah commanded us to follow something that is contradictory.

b) Imam al-Hadi (as) transmitted the madhhab of his ancestors. He did not make arbitrary independent judgements. So his fatawa was the fatawa he transmitted, not his own opinions.

c) Imam al-Hadi (as) narrated from Imam Zayd in his Al-Ahkaam. If there were any contrary ahadith or fatawa, he would have acknowledged it.

The above reasons lead some scholars to conclude that any apparent contradictions between al-Hadi (as) and Zayd (as) are a result of mistaken transmissions or interpretation.

2. There were many imams (as) who were considered authorities after al-Hadi (as) such as his sons, Imam Ahmed bin Suleiman, Imam al-Qasim bin Muhammad, and many others.

3. Yes, there is the Jami al-Kafi which compiles the fatawa of imams such as Muhammad al-Mansur, Ahmed bin Isa, and others you mentioned. The fatawa of many imams were also compiled by scholars such as Abul-Abbas al-Hasani and others. Since the Zaydia follow the opinions of the imams collectively and individually, many texts report their fatawa.

And Allah knows best!
