Wudu/hijra was created by Alexproios
Asalaamu alaikum,
I have two questions
1) I've read that Imam Nasir(as) wiped the head the same as Shafis and Twelvers(top of the head to the forelock with one hand) and that he wiped and washed his feet, both of which are at odds with the fiqh of Imam Hadi(as). Do other Imams take the same position as Imam Nasr(as) or was he unique in this?
2) I read that Imam Ismail Al Mutawakkil(as) ruled that hijra away from places where "Allah is flagrantly disobeyed" is obligatory for believers. Do other Imams also take this position?
JazakhAllah Khairan

wa alaykum as salaam wa rahma!
Thank you for your questions!
1. As for the questions regarding Imam Naasir (as) and wudu, he did hold to the view that part of the head could be wiped as evidenced in Masaa`il Naasiriyaat, Al-Intisaar and other texts. This is at variance with al-Haadi (as) because the latter held to the view that the whole head is to be wiped. However, because this is not an issue of consensus of Ahl al-Bayt, disagreement is permissible. The madhhab moreso favours al-Haadi's view over that of an-Naasir because those narrations in support of wiping over part of the head do not preclude the possibility of wiping over the whole head. Also excess is preferred over deficiency.
As for the wiping of the feet, I think there is a misunderstanding. According to Al-Bahr, Al-Intisaar and other texts, Imam an-Naasir (as) held to the view that the feet are to be washed and wiped in the wudu. It is not that he believed that they should be wiped only or that one had a choice between the two. His view is contrasted from those who say that simply running water on the feet without wiping is permissible. This is supported by the fact that in Masaa`il Naasiriyaat in the section of wudu, it says: "It is impermissible to wipe over the leather socks if one has the ability to wash them." This clearly demonstrates the view that Imam Naasir (as) advocated for washing the feet.
2. As for the obligation of hijra, this is not unique to Imam Mutawakkil (as). There is a section dedicated to hijra in the Ahkaam of Imam al-Haadi (as) as well as Al-Bahr. One of the earliest mentions of the obligation of hijra is a treatise from Imam al-Qaasim ar-Rassi (as) called Hijra lil-Dhaalimeen. In it, he proves the obligation of hijra from societies in which major sins are committed openly where one is unable to prevent and object to them. He primarily uses the Qur'an to prove this.
And Allah knows best!

Thank you for your reply,
I have a few follow up questions:
1) What I meant to say was that I read Imam Nasr(as) ruled wiping/washing together in a single ablution to be obligatory, not that wiping alone is sufficient. Does a person following this method of wudu wipe each foot and then wash them, or wipe/wash the right foot and then wipe/wash the left foot?
2) Since hijra is generally understood as an obligation by our Imams, are there any avenues available for western converts like myself who want to migrate? On a side note, are there any remaining works of fiqh attributed to Imam Mutawakkil(as)?
JazakhAllah Khairan

Thank you for your questions!
1. Thanks for your clarification! As far as I know, you would simply wash and wipe (i.e. rub) each foot at the same time. This is because Imam Naasir (as) held rubbing to be an obligation in the wudu.
2. As for migration, you would have to do what is in your ability. Our books of fiqh very clearly delineate the lands of kufr from the lands of Islam; there's no disagreement there. However, Imam al-Qaasim ar-Rassi (as) goes a step further and says that one is even obligated to migrate within Muslim lands from places of open disobedience. You would have to move somewhere where you could at least openly object to such disobedience without fear of death or imprisonment. That would leave very few so-called 'Muslim' countries today! Keep in mind, I'm not saying that you must object, but you would have to at least be able to without fear if you chose to.
As for migration strategies, if you are serious about it, I'd advise you to make a very firm intention first and know why you are doing what you are doing. Second, I would start researching into various places in the Muslim world that would be suitable for you; consider things like cost of living, security, amenities, etc. Third, I'd look into various businesses and services that you would be able to provide where you want to go. For example, the ESL field is still very relevant in the Muslim world. If you already have a trade or interest, try to see which places can be better served by your skills. The best route would be starting some type of business, as our imams (as) praise business as the chief source of income. This would, of course, entail research and visits beforehand. Finally, be aware that the dunya is still the dunya wherever it is. Your life will be challenging trying to adjust and adapt to new surroundings and cultures. However, the important thing is to constantly revisit your niyya. If your intention is sound and you are doing it only for Allah's sake, you will be rewarded regardless, inshaAllah. Your challenges and hardships will seem small in comparison to your iman and reward inshaAllah. Keep Allah first! There's a lot more I could say, but I'll leave it at that.
As for any other fiqh works of Imam al-Mutawakkil (as), I know of none offhand.
And Allah knows best!
